Overview
This limited liability company based in Nigeria, Kaka Ride, LLC., and its affiliates (collectively, "Kaka Ride," or the "Company") run the www.kakaride.com website, the "Kaka Ride" mobile application that can be downloaded from the Apple App Store and Android Play Store, and other associated websites, mobile applications, goods, and services, including the Kaka Ride Services (described below) (collectively, the "Platform").
Please read these Terms of Use carefully before you download, install or use the App. By downloading, installing or using the App, you indicate that you accept these Terms of Use and that you agree to abide by them. Your download, installation or use of the App constitutes your acceptance of these Terms of Use which takes effect on the date on which you download, install or use the App. If you do not agree with these Terms of Use, you should cease downloading, installing or using the App immediately.
ACCEPTANCE OF TERMS: By accessing or using Kaka Ride Car Hailing services, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.
ELIGIBILITY: You must be at least 18 years old to use Kaka Ride Car Hailing services. By using our services, you represent and warrant that you are of legal age to form a binding contract.
With Respect to Minor
a. You confirm that your child's use of the service is entirely voluntary and you accept all risks involved therein. Therefore, Kaka Ride Limited and its directors, management, employees/staff, representatives and agents shall not be liable for any loss, damage, injury or illness of any nature whatsoever(to my person or property)and for any cause whatsoever suffered by you or your child, directly or indirectly, as a result of using Kaka Ride Limited's services. Or property) and for any cause whatsoever, and Kaka Ride Limited and its directors, management, employees/staff, representatives and agents shall not be liable for any loss and/or damage (including indirect or consequential loss and/or damage) arising there from. You hereby declare that you have read, understand and agree to be bound by the terms and conditions of this Agreement.
b. You hold Kaka Ride Limited and its directors, management, employees, representatives and agents harmless from any and all liability that Kaka Ride Limited and/or any of its employees or other persons may incur, directly or indirectly, as a result of providing activities to your child and/or your child's use of the service, indemnify and hold harmless Kaka Ride Limited from and against any and all liability, claims, losses or damages of any nature that may be incurred, if such claims, losses or damages are caused by the negligence or willful act or omission of you or your child.
USER ACCOUNT
These User Account Terms and Conditions ("Terms") govern the creation and use of user accounts on the Kaka Ride Car Hailing platform. By creating and using a Kaka Ride user account, you agree to abide by these Terms.
To use our services, you must create a user account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Account Creation and Eligibility:
a. To create a Kaka Ride user account, you must be at least 18 years old.
b. You agree to provide accurate, current, and complete information during the account registration process.
c. You are responsible for maintaining the confidentiality of your account information and ensuring the security of your password.
Account Usage:
a. Your Kaka Ride user account is for personal use only. You may not transfer or share your account with others.
b. You are responsible for all activities that occur under your account.
c. Kaka Ride reserves the right to refuse service, terminate accounts, or cancel rides at its discretion.
Verification:
a. Kaka Ride may require you to verify your identity through the submission of identification documents and also the use of 3D facial verification.
b. You agree to cooperate with any identity verification process initiated by Kaka Ride.
Communication:
a. Kaka Ride may use the contact information provided by you for account-related communications.
b. You consent to receive communications from Kaka Ride, including promotional messages and updates.
Security:
a. You agree to notify Kaka Ride immediately if you become aware of any unauthorized access to or use of your account.
b. Kaka Ride is not responsible for any loss or damage resulting from unauthorized access to your account.
Account Termination:
a. Kaka Ride reserves the right to suspend or terminate your account for violations of these Terms or for any other reason at our discretion.
b. You may terminate your account at any time by contacting Kaka Ride customer support.
c. It is your agreement to keep the information on your Account current, correct, and full. You might not be able to access or use the Services, or Kaka ride might terminate these Terms with you, if you don't keep accurate, complete, and up-to-date Account information, including having an invalid or expired payment method on file.
User Conduct:
a. You agree to use your Kaka Ride account in compliance with applicable laws and regulations.
b. Harassment, discrimination, or any form of inappropriate behavior is strictly prohibited.
Data Protection:
a. Kaka Ride is committed to protecting your personal information. Please refer to our Privacy Policy for details on how we handle your data.
Changes to Terms:
a. Kaka Ride may update these User Account Terms and Conditions at any time.
b. Users will be notified of significant changes, and continued use of the account after such changes constitute acceptance.

SERVICE USAGE
Zero Tolerance for Misconduct:
a. Kaka Ride maintains a zero-tolerance policy for any form of harassment, discrimination, or inappropriate behavior.
b. Users engaging in misconduct may face immediate suspension or termination of their accounts.
Respectful Conduct:
a. Users are expected to treat drivers and other passengers with respect and courtesy. b. Any disruptive or disrespectful behavior is strictly prohibited.
Non-Discrimination:
a. Discrimination based on ethnic, gender, religion, sexual orientation, or any other protected characteristic is strictly prohibited.
b. Drivers and passengers are expected to provide a welcoming and inclusive environment.
Safety and Security:
a. Users must adhere to safety guidelines provided by Kaka Ride, including but not limited to seatbelt usage.
b. Any action that compromises the safety of the driver, passenger, or the general public is strictly prohibited.
Responsible Alcohol Consumption:
a. Users are responsible for their own behavior and alcohol consumption during rides.
b. Any user found to be excessively intoxicated or causing disruption due to alcohol consumption may be banned from using Kaka Ride services.
Accountability for Damages:
a. Users are responsible for any damage caused to the vehicle or property during the ride.
b. Intentional or reckless damage may result in legal action and account suspension.
Compliance with Local Laws:
a. Users must comply with all applicable laws and regulations during the ride.
b. Any illegal activity during a ride is strictly prohibited.
Compliance Monitoring:
a. Kaka Ride reserves the right to monitor user behavior and take appropriate action against violators.
b. Users may be subject to suspension or termination without prior notice for severe violations.
Changes to Strict Terms:
a. Kaka Ride reserves the right to update these Strict Service Usage Terms and Conditions at any time.
b. Users will be notified of significant changes, and continued use of the services after such changes constitute acceptance.
RIDE REQUEST
Users may request rides through the Kaka Ride Car Hailing mobile application. By making a request, you agree to the terms and conditions.
These terms and conditions govern the process of requesting and using ride services on the Kaka Ride Car Hailing platform. By initiating a ride request, you agree to adhere to the following terms and conditions:
1. Account and Eligibility:
a. Users must have a valid Kaka Ride account to request rides.
b. Riders must be at least 18 years old to use Kaka Ride services.
2. Ride Request Process:
a. Users initiate a ride request by opening the Kaka Ride mobile application and entering their destination.
b. Users must confirm their pick-up location accurately on the map or manually enter the address.
c. Riders are required to choose the appropriate ride option (e.g., Kaka Standard, Kaka XL) based on their needs.
3. Availability and Confirmation:
a. Ride requests are subject to the availability of nearby drivers.
b. Once a ride request is made, nearby drivers have the option to accept or decline the request.
c. Riders will receive confirmation details, including the driver's name, photo, vehicle type, and license plate number upon acceptance.
4. Cancellation Policy:
a. Users may cancel a ride request at any time before the driver arrives.
b. A cancellation fee may apply if the cancellation occurs after a certain period or if there are repeated cancellations.
c. Riders should not cancel any ride on driver’s request during a ride. This may pose a security threat to the rider as the company may not be aware weather the ride took the ride or not. Riders should report any driver telling a Rider to cancel a ride before the trip.
5. Waiting Time:
a. Drivers are expected to arrive promptly at the pick-up location.
b. If a driver is excessively delayed, users may contact Kaka Ride customer support for assistance.
6. In-App Communication:
a. Users and drivers are encouraged to use the in-app communication features for any necessary communication.
b. Users should not share personal contact information with drivers or attempt to communicate outside the app.
7. Conduct During the Ride:
a. Riders are expected to treat drivers with respect and adhere to a code of conduct during the ride.
b. Any form of harassment, discrimination, or inappropriate behavior is strictly prohibited.
8. Safety Checks:
a. Users must verify the identity of the driver and the vehicle details before entering the vehicle.
b. Drivers should confirm the identity of the rider to ensure a secure and safe experience.
9. Completion of the Ride:
a. Riders must confirm the completion of the ride within the Kaka Ride app upon reaching the destination.
b. Payment will be automatically processed through the registered payment method.
9B. Attempts at Fare Evasion:
a. Fraudulent Activity: Riders must not engage in any fraudulent activity to evade paying the appropriate fare for the ride.
b. Use of Unauthorized Payment Methods: Only authorized and valid payment methods should be used for Kaka Ride transactions.
9C. Payment:
a. Payment for rides is processed through the Kaka Ride Car Hailing platform. Users must provide accurate and up-to-date payment information.
b. Pricing and Payments
c. Fares: Fares are determined by Kaka Ride Car Hailing based on factors such as distance, time, and demand. The fare will be displayed to users before confirming a ride.
d. Payment Disputes: Disputes related to fares or payments should be reported to Kaka Ride Car Hailing customer support for resolution
e.. Users should review the fare details and contact Kaka Ride customer support for any discrepancies.
10. Strict Payment Compliance:
a. Users must ensure timely and accurate payment for rides.
b. Fraudulent or unauthorized payment activities will result in immediate account suspension.
11. Feedback and Ratings:
a. Riders are encouraged to provide honest feedback and ratings for drivers after each ride.
b. Kaka Ride uses feedback to maintain and improve the quality of its services.
12. Emergency Assistance:
a. In case of an emergency, riders can use the emergency button within the app to quickly connect with local authorities.
b. Familiarize yourself with safety features available in the app for emergency situations.
13. Compliance with Local Laws:
a. Riders must comply with all applicable local laws and regulations of the Federal Republic of Nigeria during the ride.
14. Changes to Terms:
a. Kaka Ride reserves the right to update these Ride Request Terms and Conditions at any time.
b. Users will be notified of significant changes, and continued use of the services after such changes constitute acceptance.
PROHIBITED ACTIONS DURING RIDE REQUEST
To ensure a safe and enjoyable experience for all users, Kaka Ride has established guidelines outlining actions that riders must avoid during a ride request. By using our services, riders agree to refrain from the following prohibited actions:
**1. Inappropriate Behavior:
a. Harassment: Riders must not engage in any form of harassment, whether verbal or physical, towards the driver or other passengers.
b. Discrimination: Discriminatory behavior based on ethnic, gender, religion, sexual orientation, or any other protected characteristic is strictly prohibited.
**2. Disrespectful Conduct:
a. Disrespect towards Drivers: Riders are expected to treat drivers with respect and courtesy throughout the ride.
b. Disruptive Actions: Disruptive behavior that interferes with the driver's ability to operate the vehicle or compromises the safety of the ride is not allowed.
**3. Excessive Intoxication:
a. Inebriation: Riders must not be excessively intoxicated during a ride, as it can lead to disturbances and safety concerns.
b. Consumption of Illegal Substances: The use of illegal substances during a ride is strictly prohibited.
**4. Non-Compliance with Safety Guidelines:
a. Seatbelt Neglect: Riders must wear seatbelts as required by local laws and regulations.
b. Failure to Follow Safety Instructions: Riders should adhere to any safety instructions provided by the driver during the ride.
**5. Sharing Personal Contact Information:
a. Communication Outside the App: Riders should not attempt to communicate with the driver outside the Kaka Ride app or share personal contact information.
**6. Attempts at Fare Evasion:
a. Fraudulent Activity: Riders must not engage in any fraudulent activity to evade paying the appropriate fare for the ride.
b. Use of Unauthorized Payment Methods: Only authorized and valid payment methods should be used for Kaka Ride transactions.
**7. Intentional Damage to the Vehicle:
a. Vandalism: Any form of intentional damage to the vehicle, its contents, or property is strictly prohibited.
b. Negligent Actions: Riders must not engage in actions that could result in damage to the vehicle, such as spilling substances or causing deliberate harm.
**8. Distraction of the Driver:
a. Distracting the Driver: Riders must refrain from distracting the driver during the operation of the vehicle.
b. Interference with Vehicle Controls: Any interference with the driver's ability to operate the vehicle is strictly prohibited.
**9. Failure to Comply with Local Laws:
a. Illegal Activities: Riders must not engage in any illegal activities during the ride, including but not limited to substance abuse or carrying prohibited items.
b. Non-Compliance with Local Regulations: Riders should comply with all local laws and regulations during the ride.
**10. Failure to Verify Driver and Vehicle:
a. Neglecting Safety Checks: Riders must verify the driver's identity and check the vehicle details before entering the vehicle.
b. Ignoring Safety Features: Riders should familiarize themselves with safety features available in the Kaka Ride app for emergency situations.
**11. False Reports or Complaints:
a. Misuse of Feedback System: Riders should provide honest and accurate feedback, refraining from making false reports or complaints against drivers.
**12. Non-Compliance with Kaka Ride Policies:
a. Violation of Terms and Conditions: Riders must comply with the Kaka Ride Terms and Conditions, and any violation may result in account suspension or termination.
By refraining from these prohibited actions, riders contribute to a positive and secure environment for all users of Kaka Ride services. Failure to comply with these guidelines may result in account suspension or termination.
5. Safety and Security
a. Identification: Users must verify the identity of the driver before entering the vehicle. Drivers must also verify the identity of the passenger.
8. Termination
Kaka Ride Car Hailing reserves the right to terminate or suspend any user account for violations of these Terms and Conditions or for any other reason at our discretion.
9. Changes to Terms
Kaka Ride Car Hailing may update these Terms and Conditions at any time. Users will be notified of significant changes, and continued use of our services after such changes constitute acceptance.
TEXT MESSAGES AND NOTIFICATIONS
You acknowledge that the Services may send you text (SMS) messages as part of regular business operations when you create an account. Kaka Ride's text (SMS) messaging service may be opted out of at any time by following the instructions at https://www.kakaride.com/unsubscribe/. You understand that using the Services may be impacted if you choose not to receive text (SMS) messages.
PROMOTIONS AND PROMO CODES
Subject to any additional terms that Kaka Ride establishes for each promotional code (referred to as "Promo Codes"), Kaka Ride may, at its sole discretion, create promotional codes that can be redeemed for Account credit or other features or benefits related to the Services and/or a Third Party Provider's services. You warrant that Promo Codes:
(i) be used for the intended audience and purpose, and in a lawful manner;
(ii) not be copied, sold, transferred, or made available to the public in any way, whether posted to a public form or not, unless Kaka Ride specifically permits it;
(iii) Kaka Ride has the right to disable Promo Codes at any time for any reason, without incurring any liability.
(iv) are only used in accordance with the conditions that Kaka Ride specifies for each Promo Code;
(v) aren't exchangeable for cash; and
(vi) can expire before you use them. In the event that Kaka ride determines or believes that the use or redemption of the Promo Code was incorrect, fraudulent, unlawful, or in violation of the applicable Promo Code terms or these Terms, Kaka Ride reserves the right to withhold or deduct credits or other features or benefits obtained by you or any other user through the use of Promo Codes.
DEVICES AND NETWORK ACCESS
The data network access required to use the Services is your responsibility to obtain. If you access or use the Services from a wirelessly equipped device, you may be subject to data and messaging rates and costs from your mobile network, for which you are exclusively liable. The devices that you need to access and utilize the Services and Applications, as well as any upgrades to them, must be updated or purchased by you. Uber disclaims all responsibility for the functionality of the Services, in whole or in part, on any specific hardware. Furthermore, the usage of the Internet and digital communication may introduce delays and malfunctions to the Services.
MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
LIMITATION OF OUR RESPONSIBILITY
The content of the services is offered "as is" and "as available." unless otherwise stated in these terms, kaka ride disclaims all representations and warranties, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Additionally, kaka ride does not warrant or giveaway anything about the services' reliability, timeliness, quality, suitability, or availability, or about any services or goods requested through the services, or that the services will be error-free or uninterrupted. The quality, suitability, safety, or ability of third-party providers are not guaranteed by kaka ride. You agree that you alone assume all risk arising from your use of the services and any goods or services requested in connection therewith.
a. Kaka Ride accepts no liability to any User for any loss or damage, whether foreseeable or otherwise, in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising out of or in connection with the use of (or inability to use) Our Application or the use of or reliance upon any Content (including User Content) included on Our Application.
b. Reasonable skill and care shall be exercised to ensure that Our Application is free from viruses and other malware. However, Kaka Ride accept no liability for any loss or damage resulting from a virus or other malware, distributed denial-of-service attack, or other harmful material or event that may adversely affect your hardware, software, data, or other material that occurs as a result of your use of Our Application (including the downloading of any Content from it) or any other site referred to on Our Application.
c. Kaka Ride neither assume nor accept responsibility or liability arising out of any disruption or non-availability of Our Application resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, natural events, acts of war, or legal restrictions and censorship.
d. We will not be held responsible for the conduct of the passenger or other passengers, nor will we be held accountable for any loss or damage that the passenger or other passengers may cause to you or your car.
e. No Liability for Consequential Damages: Kaka Ride shall not be liable for any indirect, consequential, special, or incidental damages, including but not limited to loss of profits, data, or use, arising out of or in connection with the use or inability to use the Kaka Ride platform or services. b. No Liability for Third-Party Actions: Kaka Ride is not responsible for the actions, conduct, or negligence of drivers, passengers, or any third parties using the platform. c. No Liability for Service Interruptions: Kaka Ride shall not be liable for any service interruptions, including system failures, maintenance, or unforeseen events that may temporarily disrupt the availability of the platform.
INDEMNITY
a. User Responsibility: Users agree to indemnify and hold Kaka Ride, its affiliates, officers, directors, employees, and agents harmless from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising out of or in connection with: i. User's use of the Kaka Ride platform or services. ii. Violation of these Terms and Conditions or any applicable laws. iii. User's negligence, misconduct, or breach of any obligations.
b. Indemnification Process: In the event of a claim, Kaka Ride will promptly notify the user of the claim and provide reasonable assistance in the user's defense. Users agree to cooperate with Kaka Ride in the defense of such claims.
FORCE MAJEURE
a. No Liability for Force Majeure Events: Kaka Ride shall not be liable for any failure or delay in the performance of its obligations under these Terms and Conditions due to acts beyond its reasonable control, including but not limited to natural disasters, acts of government, acts of terrorism, strikes, or pandemics.
NO WARRANTIES
a. As-Is Basis: Kaka Ride provides the platform and services on an "as-is" and "as-available" basis. Kaka Ride makes no representations or warranties of any kind, express or implied, regarding the platform or services, including but not limited to the availability, accuracy, or reliability of the information.
LIMITATION OF DAMAGES
a. Maximum Liability: Kaka Ride's total liability for any and all claims arising out of or in connection with the use of the platform or services shall not exceed the total amount paid by the user to Kaka Ride for the specific services giving rise to the claim in the twelve (12) months preceding the claim.
GOVERNING LAW AND JURISDICTION
a. Applicable Law: These provisions shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles. b. Exclusive Jurisdiction: Users agree that any dispute arising out of or relating to these provisions shall be resolved exclusively in the courts of [Jurisdiction], and the parties hereby consent to the personal jurisdiction of such courts.
MODIFICATION OF TERMS
a. Right to Modify: Kaka Ride reserves the right to modify these limitation of liability and indemnity provisions at any time.
b. Notification: Users will be notified of material changes, and continued use of the platform after such changes constitute acceptance of the modified terms.
By using Kaka Ride services, users acknowledge and agree to these limitation of liability and indemnity provisions. If you violate the General Terms, the Agreement, or any other applicable laws or regulations, you will be held fully responsible and will need to halt and correct the violation as soon as we or any state body make a demand on you. You agree to hold us harmless from any direct or indirect loss, damage, profit loss, cost, penalty, or fine that we may incur as a result of your violation of the general terms, agreement, laws, and regulations.
KAKA RIDE - DRIVER TERMS AND CONDITIONS
These terms and conditions ("Terms") govern the relationship between Kaka Ride and its drivers. By using the Kaka Ride platform, drivers agree to abide by these Terms.
1. Driver Eligibility:
a. Drivers must meet all legal requirements to operate a vehicle in the jurisdiction they serve.
b. Drivers must possess a valid driver's license and vehicle registration. c. Drivers must be at least 21 years old.
2. Kaka Ride Platform Usage:
a. Drivers must use the Kaka Ride platform only for the purpose of providing transportation services to riders.
b. Drivers are responsible for maintaining the confidentiality of their account credentials.
c. Drivers must book all ride on the app. No driver is allowed to take a ride offline.
d. Cancellation of rides may lead to termination of the driver’s account.
3. Vehicle Requirements:
a. Vehicles must meet Kaka Ride's minimum standards for safety, cleanliness, and comfort.
b. Drivers are responsible for ensuring their vehicle is well-maintained and meets local regulations.
4. Background Checks:
a. Drivers must consent to and pass background checks conducted by Kaka Ride.
b. Convictions for certain criminal offenses may disqualify drivers from using the platform.
5. Ratings and Feedback:
a. Drivers are subject to rider ratings and feedback.
b. Consistently low ratings or reports of misconduct may result in account suspension or termination.
6. Payment and Earnings:
a. Earnings are based on completed rides as recorded by the Kaka Ride app.
b. Payment will be processed through the platform, and drivers agree to the payment terms set by Kaka Ride.
7. Piggy Bank Savings Program:
a. Drivers are automatically enrolled in the Piggy Bank Savings Program.
b. Savings can be withdrawn yearly or quarterly for purposes such as car maintenance or personal goals.
8. Safety and Conduct:
a. Drivers must follow all local traffic laws and regulations.
b. Harassment, discrimination, or any inappropriate behavior towards riders is strictly prohibited.
9. Insurance:
a. Drivers are responsible for maintaining adequate insurance coverage for their vehicles as required by local laws.
10. Amendments to Terms:
a. Kaka Ride reserves the right to amend these Terms at any time.
b. Drivers will be notified of amendments, and continued use of the platform after changes constitutes acceptance.
11. Termination of Account:
a. Kaka Ride reserves the right to suspend or terminate a driver's account for violations of these Terms or for any other reason at its discretion.
b. Drivers may terminate their account at any time.
12. Independent Contractor Relationship:
a. Drivers acknowledge and agree that they are independent contractors and not employees of Kaka Ride.
b. Drivers are responsible for their own taxes, insurance, and other business-related obligations.
13. Force Majeure:
a. Kaka Ride shall not be liable for any failure or delay in performance due to events beyond its control, including natural disasters, acts of government, or acts of terrorism.
14. Governing Law:
a. These Terms shall be governed by the laws applicable to the region in which the driver operates.

KAKA RIDE - DRIVER'S WELFARE AND PIGGY BANK SAVINGS PROGRAM
At Kaka Ride, we are committed to prioritizing the welfare of our valued drivers. In recognition of the essential role they play in our community, we have introduced a unique Piggy Bank Savings Program designed to enhance their financial well-being. This program allows drivers to save a portion of their earnings, which can be withdrawn yearly or quarterly, providing a safety net for unforeseen circumstances such as car accidents or other personal needs.
1. Piggy Bank Savings Program:
a. Opt-In Participation: All Kaka Ride drivers are automatically enrolled in the Piggy Bank Savings Program.
b. Voluntary Savings: Drivers can opt to save a percentage of their earnings into their Piggy Bank account after each completed ride.
c. Flexible Withdrawal Options: Savings can be withdrawn either yearly or quarterly, giving drivers flexibility based on their individual financial needs.
2. Purpose of the Piggy Bank Savings:
a. Car Maintenance: The savings can be utilized for general car maintenance, repairs, and servicing to ensure the safety and reliability of the driver's vehicle.
